開展(zhan)“證(zheng)照(zhao)分離(li)”改革(ge),是落實黨中央、國(guo)務(wu)院(yuan)重(zhong)大決策部署(shu),深(shen)化“放管服”改革(ge)、優化營商環(huan)境的重(zhong)要舉措,對于(yu)正(zheng)確處理政府和市場(chang)關(guan)系、加快(kuai)完(wan)善社會主義(yi)市場(chang)經(jing)濟(ji)體制具(ju)有(you)重(zhong)大意義(yi)。為深(shen)化“證(zheng)照(zhao)分離(li)”改革(ge),進一步激發市場(chang)主體發展(zhan)活力,國(guo)務(wu)院(yuan)決定在全國(guo)范圍內(nei)推行“證(zheng)照(zhao)分離(li)”改革(ge)全覆蓋(gai),并在自由(you)貿易(yi)試(shi)驗區加大改革(ge)試(shi)點力度。現(xian)就有(you)關(guan)事項通知如下:(一)指導思想。以(yi)(yi)習(xi)近平新(xin)時代中(zhong)(zhong)(zhong)國特(te)色社會(hui)主義思想為指導,全面貫(guan)徹(che)黨的(de)十九大(da)和(he)十九屆二中(zhong)(zhong)(zhong)、三中(zhong)(zhong)(zhong)、四中(zhong)(zhong)(zhong)、五(wu)中(zhong)(zhong)(zhong)全會(hui)精神,持續(xu)深化(hua)“放管服(fu)”改革(ge),統(tong)籌(chou)推進行(xing)政審(shen)批制度(du)改革(ge)和(he)商事(shi)制度(du)改革(ge),在更(geng)大(da)范圍和(he)更(geng)多行(xing)業推動照后(hou)減證和(he)簡化(hua)審(shen)批,創新(xin)和(he)加強事(shi)中(zhong)(zhong)(zhong)事(shi)后(hou)監管,進一步優(you)化(hua)營(ying)商環境(jing)、激發市場主體發展(zhan)活力(li),加快構建以(yi)(yi)國內(nei)(nei)大(da)循(xun)環為主體、國內(nei)(nei)國際雙循(xun)環相互促進的(de)新(xin)發展(zhan)格局(ju)。(二)改(gai)革目標。自2021年(nian)7月(yue)1日起,在全國范圍內實(shi)施涉(she)企經(jing)營許可事項全覆蓋清單(dan)管理,按照直接取消(xiao)審批(pi)(pi)、審批(pi)(pi)改(gai)為備(bei)案、實(shi)行告(gao)知承諾(nuo)、優化審批(pi)(pi)服務等(deng)四種方式分類推進審批(pi)(pi)制度改(gai)革,同時在自由貿易試驗區進一步加大改(gai)革試點力(li)度,力(li)爭2022年(nian)底前建立簡約高效、公正透明、寬進嚴管的(de)行業準營規則(ze),大幅提(ti)高市(shi)場主體辦事的(de)便利(li)度和可預期性。二、大力推(tui)動照(zhao)后(hou)減證和簡化審(shen)批(pi)法律(lv)、行(xing)(xing)政法規(gui)、國(guo)務院決定(ding)設(she)(she)定(ding)(以(yi)下統(tong)稱中央(yang)層面(mian)設(she)(she)定(ding))的(de)涉(she)企經營(ying)(ying)許(xu)(xu)可事(shi)項,在(zai)全國(guo)范(fan)圍內按(an)照(zhao)《中央(yang)層面(mian)設(she)(she)定(ding)的(de)涉(she)企經營(ying)(ying)許(xu)(xu)可事(shi)項改(gai)革(ge)(ge)清(qing)(qing)單(dan)(2021年全國(guo)版)》(見(jian)附件(jian)1)分(fen)類實施改(gai)革(ge)(ge);在(zai)自(zi)(zi)由(you)貿易試(shi)驗(yan)(yan)區(qu)(qu)增(zeng)加實施《中央(yang)層面(mian)設(she)(she)定(ding)的(de)涉(she)企經營(ying)(ying)許(xu)(xu)可事(shi)項改(gai)革(ge)(ge)清(qing)(qing)單(dan)(2021年自(zi)(zi)由(you)貿易試(shi)驗(yan)(yan)區(qu)(qu)版)》(見(jian)附件(jian)2)規(gui)定(ding)的(de)改(gai)革(ge)(ge)試(shi)點舉措,自(zi)(zi)由(you)貿易試(shi)驗(yan)(yan)區(qu)(qu)所在(zai)縣、不設(she)(she)區(qu)(qu)的(de)市、市轄區(qu)(qu)的(de)其他區(qu)(qu)域參(can)照(zhao)執行(xing)(xing)。省級(ji)(ji)人(ren)民政府(fu)可以(yi)在(zai)權(quan)限范(fan)圍內決定(ding)采取更(geng)大力(li)度的(de)改(gai)革(ge)(ge)舉措。地(di)方(fang)(fang)性(xing)法規(gui)、地(di)方(fang)(fang)政府(fu)規(gui)章設(she)(she)定(ding)(以(yi)下統(tong)稱地(di)方(fang)(fang)層面(mian)設(she)(she)定(ding))的(de)涉(she)企經營(ying)(ying)許(xu)(xu)可事(shi)項,由(you)省級(ji)(ji)人(ren)民政府(fu)統(tong)籌確定(ding)改(gai)革(ge)(ge)方(fang)(fang)式。(一)直接取(qu)(qu)消(xiao)審(shen)批。為在(zai)外資外貿(mao)、工程建(jian)設、交通物流、中介服務等領域破解“準(zhun)入(ru)不準(zhun)營(ying)(ying)”問題(ti),在(zai)全(quan)國范(fan)圍內(nei)取(qu)(qu)消(xiao)68項(xiang)涉(she)企(qi)(qi)(qi)經營(ying)(ying)許(xu)(xu)可(ke)事項(xiang),在(zai)自由貿(mao)易試(shi)(shi)驗區試(shi)(shi)點取(qu)(qu)消(xiao)14項(xiang)涉(she)企(qi)(qi)(qi)經營(ying)(ying)許(xu)(xu)可(ke)事項(xiang)。取(qu)(qu)消(xiao)審(shen)批后,企(qi)(qi)(qi)業(含個體工商(shang)戶、農民專(zhuan)業合作(zuo)社,下(xia)同)取(qu)(qu)得營(ying)(ying)業執(zhi)照即可(ke)開(kai)展(zhan)經營(ying)(ying),行(xing)政(zheng)機關(guan)、企(qi)(qi)(qi)事業單位、行(xing)業組(zu)織(zhi)等不得要(yao)求企(qi)(qi)(qi)業提供相(xiang)關(guan)行(xing)政(zheng)許(xu)(xu)可(ke)證件(jian)。(二)審批改為(wei)備(bei)案(an)(an)。為(wei)在(zai)貿(mao)易流通、教育培(pei)訓、醫療(liao)、食品(pin)、金(jin)融等領域放開市場準入,在(zai)全國(guo)范圍(wei)內將15項(xiang)(xiang)涉企經(jing)營(ying)許可事(shi)(shi)項(xiang)(xiang)改為(wei)備(bei)案(an)(an)管理,在(zai)自由貿(mao)易試(shi)(shi)驗區試(shi)(shi)點將15項(xiang)(xiang)涉企經(jing)營(ying)許可事(shi)(shi)項(xiang)(xiang)改為(wei)備(bei)案(an)(an)管理。審批改為(wei)備(bei)案(an)(an)后,原則上實行事(shi)(shi)后備(bei)案(an)(an),企業(ye)取得(de)營(ying)業(ye)執照即可開展(zhan)(zhan)經(jing)營(ying);確需事(shi)(shi)前備(bei)案(an)(an)的,企業(ye)完成備(bei)案(an)(an)手續即可開展(zhan)(zhan)經(jing)營(ying)。企業(ye)按規(gui)定提(ti)交備(bei)案(an)(an)材料的,有關主(zhu)管部(bu)門(men)應(ying)當(dang)當(dang)場辦理備(bei)案(an)(an)手續,不(bu)得(de)作(zuo)出不(bu)予備(bei)案(an)(an)的決定。(三)實(shi)(shi)行(xing)(xing)告(gao)知(zhi)(zhi)承(cheng)(cheng)(cheng)諾(nuo)(nuo)。為在(zai)(zai)農業(ye)(ye)、制造(zao)業(ye)(ye)、生(sheng)(sheng)產服務、生(sheng)(sheng)活消費、電信(xin)、能(neng)源(yuan)等領域大幅簡(jian)化準入(ru)審(shen)批,在(zai)(zai)全(quan)國范圍內對37項涉企(qi)(qi)經營(ying)(ying)許可(ke)(ke)(ke)(ke)事項實(shi)(shi)行(xing)(xing)告(gao)知(zhi)(zhi)承(cheng)(cheng)(cheng)諾(nuo)(nuo),在(zai)(zai)自(zi)由貿易試驗區試點對40項涉企(qi)(qi)經營(ying)(ying)許可(ke)(ke)(ke)(ke)事項實(shi)(shi)行(xing)(xing)告(gao)知(zhi)(zhi)承(cheng)(cheng)(cheng)諾(nuo)(nuo)。實(shi)(shi)行(xing)(xing)告(gao)知(zhi)(zhi)承(cheng)(cheng)(cheng)諾(nuo)(nuo)后(hou),有關主管(guan)(guan)部(bu)門要(yao)(yao)依(yi)法列出(chu)可(ke)(ke)(ke)(ke)量化可(ke)(ke)(ke)(ke)操作、不(bu)含兜底條款的(de)(de)經營(ying)(ying)許可(ke)(ke)(ke)(ke)條件,明確監管(guan)(guan)規則和違反承(cheng)(cheng)(cheng)諾(nuo)(nuo)后(hou)果,一次(ci)性告(gao)知(zhi)(zhi)企(qi)(qi)業(ye)(ye)。對因企(qi)(qi)業(ye)(ye)承(cheng)(cheng)(cheng)諾(nuo)(nuo)可(ke)(ke)(ke)(ke)以(yi)減省的(de)(de)審(shen)批材(cai)料(liao),不(bu)再要(yao)(yao)求(qiu)企(qi)(qi)業(ye)(ye)提供;對可(ke)(ke)(ke)(ke)在(zai)(zai)企(qi)(qi)業(ye)(ye)領證后(hou)補(bu)交的(de)(de)審(shen)批材(cai)料(liao),實(shi)(shi)行(xing)(xing)容缺辦理、限期補(bu)交。對企(qi)(qi)業(ye)(ye)自(zi)愿作出(chu)承(cheng)(cheng)(cheng)諾(nuo)(nuo)并按要(yao)(yao)求(qiu)提交材(cai)料(liao)的(de)(de),要(yao)(yao)當場(chang)作出(chu)審(shen)批決定。對通過告(gao)知(zhi)(zhi)承(cheng)(cheng)(cheng)諾(nuo)(nuo)取得許可(ke)(ke)(ke)(ke)的(de)(de)企(qi)(qi)業(ye)(ye),有關主管(guan)(guan)部(bu)門要(yao)(yao)加(jia)強事中事后(hou)監管(guan)(guan),確有必要(yao)(yao)的(de)(de)可(ke)(ke)(ke)(ke)以(yi)開展(zhan)全(quan)覆蓋核(he)查。發現企(qi)(qi)業(ye)(ye)不(bu)符合許可(ke)(ke)(ke)(ke)條件的(de)(de),要(yao)(yao)依(yi)法調查處理,并將(jiang)失(shi)信(xin)違法行(xing)(xing)為記(ji)(ji)入(ru)企(qi)(qi)業(ye)(ye)信(xin)用(yong)記(ji)(ji)錄,依(yi)法依(yi)規實(shi)(shi)施(shi)失(shi)信(xin)懲戒。有關主管(guan)(guan)部(bu)門要(yao)(yao)及時將(jiang)企(qi)(qi)業(ye)(ye)履行(xing)(xing)承(cheng)(cheng)(cheng)諾(nuo)(nuo)情況納入(ru)信(xin)用(yong)記(ji)(ji)錄,并歸集(ji)至全(quan)國信(xin)用(yong)信(xin)息共享平臺。(四)優化(hua)審(shen)(shen)批(pi)服務(wu)(wu)。對(dui)(dui)(dui)“重要工業(ye)(ye)產(chan)品(除食品相關(guan)(guan)產(chan)品、化(hua)肥外)生產(chan)許(xu)可(ke)證核發”等(deng)(deng)15項(xiang)(xiang)(xiang)(xiang)涉(she)企(qi)(qi)(qi)經(jing)(jing)營(ying)(ying)(ying)許(xu)可(ke)事(shi)(shi)項(xiang)(xiang)(xiang)(xiang),下(xia)放審(shen)(shen)批(pi)權限(xian)(xian)(xian),便利(li)企(qi)(qi)(qi)業(ye)(ye)就近辦(ban)理。對(dui)(dui)(dui)“保安服務(wu)(wu)許(xu)可(ke)證核發”等(deng)(deng)256項(xiang)(xiang)(xiang)(xiang)涉(she)企(qi)(qi)(qi)經(jing)(jing)營(ying)(ying)(ying)許(xu)可(ke)事(shi)(shi)項(xiang)(xiang)(xiang)(xiang),精簡許(xu)可(ke)條件(jian)和審(shen)(shen)批(pi)材料,減輕企(qi)(qi)(qi)業(ye)(ye)辦(ban)事(shi)(shi)負擔。對(dui)(dui)(dui)“會計師事(shi)(shi)務(wu)(wu)所(suo)(suo)設(she)(she)立(li)(li)審(shen)(shen)批(pi)”等(deng)(deng)140項(xiang)(xiang)(xiang)(xiang)涉(she)企(qi)(qi)(qi)經(jing)(jing)營(ying)(ying)(ying)許(xu)可(ke)事(shi)(shi)項(xiang)(xiang)(xiang)(xiang),優化(hua)審(shen)(shen)批(pi)流程(cheng),壓減審(shen)(shen)批(pi)時(shi)限(xian)(xian)(xian),提高(gao)審(shen)(shen)批(pi)效(xiao)率。對(dui)(dui)(dui)“海關(guan)(guan)監(jian)管(guan)貨物倉儲審(shen)(shen)批(pi)”等(deng)(deng)18項(xiang)(xiang)(xiang)(xiang)設(she)(she)定(ding)(ding)了(le)許(xu)可(ke)證件(jian)有(you)效(xiao)期限(xian)(xian)(xian)的(de)涉(she)企(qi)(qi)(qi)經(jing)(jing)營(ying)(ying)(ying)許(xu)可(ke)事(shi)(shi)項(xiang)(xiang)(xiang)(xiang),取消或者延長許(xu)可(ke)證件(jian)有(you)效(xiao)期限(xian)(xian)(xian),方(fang)便企(qi)(qi)(qi)業(ye)(ye)持續經(jing)(jing)營(ying)(ying)(ying)。對(dui)(dui)(dui)“互聯網上網服務(wu)(wu)營(ying)(ying)(ying)業(ye)(ye)場所(suo)(suo)經(jing)(jing)營(ying)(ying)(ying)單(dan)位設(she)(she)立(li)(li)審(shen)(shen)批(pi)”等(deng)(deng)13項(xiang)(xiang)(xiang)(xiang)設(she)(she)定(ding)(ding)了(le)許(xu)可(ke)數(shu)量限(xian)(xian)(xian)制的(de)涉(she)企(qi)(qi)(qi)經(jing)(jing)營(ying)(ying)(ying)許(xu)可(ke)事(shi)(shi)項(xiang)(xiang)(xiang)(xiang),取消數(shu)量限(xian)(xian)(xian)制,或者合理放寬數(shu)量限(xian)(xian)(xian)制并定(ding)(ding)期公布總量控制條件(jian)、企(qi)(qi)(qi)業(ye)(ye)存量、申請排(pai)序(xu)等(deng)(deng)情(qing)況,鼓勵(li)企(qi)(qi)(qi)業(ye)(ye)有(you)序(xu)競(jing)爭。同時(shi),各(ge)地區、各(ge)部門(men)要積極回應企(qi)(qi)(qi)業(ye)(ye)關(guan)(guan)切,探(tan)索優化(hua)審(shen)(shen)批(pi)服務(wu)(wu)的(de)創(chuang)新舉(ju)措。三、強化改革(ge)系統(tong)集成和協同(tong)配套(tao)(一)實施涉(she)(she)企(qi)經(jing)營(ying)(ying)許(xu)可(ke)事(shi)項(xiang)(xiang)清(qing)(qing)單(dan)管(guan)理(li)。按照(zhao)全覆蓋要(yao)(yao)求,將(jiang)全部(bu)涉(she)(she)企(qi)經(jing)營(ying)(ying)許(xu)可(ke)事(shi)項(xiang)(xiang)納入清(qing)(qing)單(dan)管(guan)理(li),并(bing)逐項(xiang)(xiang)確定(ding)(ding)改革(ge)方式、具體改革(ge)舉措和加強事(shi)中事(shi)后監管(guan)措施。清(qing)(qing)單(dan)實行(xing)(xing)分級管(guan)理(li),國務(wu)院審改辦負(fu)責(ze)組織(zhi)編(bian)制(zhi)中央層(ceng)面設定(ding)(ding)的(de)涉(she)(she)企(qi)經(jing)營(ying)(ying)許(xu)可(ke)事(shi)項(xiang)(xiang)清(qing)(qing)單(dan),省(sheng)級審改工作機構(gou)負(fu)責(ze)組織(zhi)編(bian)制(zhi)地方層(ceng)面設定(ding)(ding)的(de)涉(she)(she)企(qi)經(jing)營(ying)(ying)許(xu)可(ke)事(shi)項(xiang)(xiang)清(qing)(qing)單(dan)。清(qing)(qing)單(dan)要(yao)(yao)動態調(diao)整更新并(bing)向社會(hui)公布,接受(shou)社會(hui)監督。清(qing)(qing)單(dan)之外(wai),一律不得(de)限(xian)制(zhi)企(qi)業(ye)進入相關行(xing)(xing)業(ye)開(kai)展(zhan)經(jing)營(ying)(ying)。各地區、各部(bu)門要(yao)(yao)對清(qing)(qing)單(dan)之外(wai)限(xian)制(zhi)企(qi)業(ye)進入特定(ding)(ding)行(xing)(xing)業(ye)開(kai)展(zhan)經(jing)營(ying)(ying)的(de)管(guan)理(li)事(shi)項(xiang)(xiang)進行(xing)(xing)全面自查(cha)清(qing)(qing)理(li),對實施變(bian)相審批造成市(shi)場分割或者加重企(qi)業(ye)負(fu)擔的(de)行(xing)(xing)為(wei),要(yao)(yao)嚴肅督查(cha)整改并(bing)追究責(ze)任。(二)深化商事(shi)(shi)登(deng)記(ji)制(zhi)度改(gai)(gai)革(ge)。持(chi)續推進“先照(zhao)后證”改(gai)(gai)革(ge),推動(dong)(dong)將(jiang)保留(liu)的(de)(de)登(deng)記(ji)注冊(ce)前置許(xu)可改(gai)(gai)為(wei)后置。開展(zhan)經(jing)營(ying)(ying)(ying)范圍(wei)(wei)(wei)規范化登(deng)記(ji),市場監(jian)管(guan)部門(men)(men)牽頭編制(zhi)經(jing)營(ying)(ying)(ying)范圍(wei)(wei)(wei)規范目(mu)錄,為(wei)企(qi)(qi)(qi)(qi)業(ye)自主選擇經(jing)營(ying)(ying)(ying)范圍(wei)(wei)(wei)提供服務(wu)。經(jing)營(ying)(ying)(ying)范圍(wei)(wei)(wei)規范目(mu)錄要根據新產業(ye)、新業(ye)態的(de)(de)發展(zhan)及時調整(zheng)更新。市場監(jian)管(guan)部門(men)(men)應當告知企(qi)(qi)(qi)(qi)業(ye)需要辦(ban)理的(de)(de)涉企(qi)(qi)(qi)(qi)經(jing)營(ying)(ying)(ying)許(xu)可事(shi)(shi)項,并(bing)及時將(jiang)有關企(qi)(qi)(qi)(qi)業(ye)登(deng)記(ji)注冊(ce)信息推送至有關主管(guan)部門(men)(men)。企(qi)(qi)(qi)(qi)業(ye)超(chao)經(jing)營(ying)(ying)(ying)范圍(wei)(wei)(wei)開展(zhan)非許(xu)可類經(jing)營(ying)(ying)(ying)活動(dong)(dong)的(de)(de),市場監(jian)管(guan)部門(men)(men)不予(yu)處罰。有關主管(guan)部門(men)(men)不得以(yi)企(qi)(qi)(qi)(qi)業(ye)登(deng)記(ji)的(de)(de)經(jing)營(ying)(ying)(ying)范圍(wei)(wei)(wei)為(wei)由,限制(zhi)其(qi)辦(ban)理涉企(qi)(qi)(qi)(qi)經(jing)營(ying)(ying)(ying)許(xu)可事(shi)(shi)項或者其(qi)他政務(wu)服務(wu)事(shi)(shi)項。在(zai)自由貿易(yi)試(shi)驗(yan)區(qu)試(shi)點商事(shi)(shi)主體(ti)登(deng)記(ji)確(que)認制(zhi)改(gai)(gai)革(ge),最大程度尊重企(qi)(qi)(qi)(qi)業(ye)登(deng)記(ji)注冊(ce)自主權。(三)推(tui)進電(dian)子(zi)證(zheng)(zheng)照(zhao)(zhao)(zhao)歸集運(yun)用。國務院(yuan)有關(guan)部(bu)門(men)(men)要制定完善電(dian)子(zi)證(zheng)(zheng)照(zhao)(zhao)(zhao)有關(guan)標準(zhun)、規范和(he)樣式,2022年底前全(quan)(quan)(quan)面實現(xian)涉企(qi)證(zheng)(zheng)照(zhao)(zhao)(zhao)電(dian)子(zi)化(hua)。要強(qiang)化(hua)電(dian)子(zi)證(zheng)(zheng)照(zhao)(zhao)(zhao)信息(xi)跨層(ceng)級、跨地域、跨部(bu)門(men)(men)共享(xiang)(xiang),有關(guan)主管部(bu)門(men)(men)應當及時將電(dian)子(zi)證(zheng)(zheng)照(zhao)(zhao)(zhao)歸集至全(quan)(quan)(quan)國一(yi)(yi)體化(hua)政(zheng)務服(fu)務平(ping)(ping)臺、全(quan)(quan)(quan)國信用信息(xi)共享(xiang)(xiang)平(ping)(ping)臺、國家企(qi)業信用信息(xi)公示系(xi)統,有關(guan)平(ping)(ping)臺和(he)系(xi)統要加快建設全(quan)(quan)(quan)國統一(yi)(yi)、實時更新、權威可靠(kao)的企(qi)業電(dian)子(zi)證(zheng)(zheng)照(zhao)(zhao)(zhao)庫(ku)。要加強(qiang)電(dian)子(zi)證(zheng)(zheng)照(zhao)(zhao)(zhao)運(yun)用,實現(xian)跨地域、跨部(bu)門(men)(men)互(hu)(hu)認(ren)互(hu)(hu)信,在政(zheng)務服(fu)務、商業活動等(deng)場景普遍(bian)推(tui)廣企(qi)業電(dian)子(zi)亮(liang)(liang)照(zhao)(zhao)(zhao)亮(liang)(liang)證(zheng)(zheng)。凡(fan)是(shi)通過電(dian)子(zi)證(zheng)(zheng)照(zhao)(zhao)(zhao)可以獲(huo)取的信息(xi),一(yi)(yi)律不再要求企(qi)業提(ti)供相應材(cai)料。四、創新和(he)加強事中事后監(jian)管(guan)(一)適應(ying)改(gai)(gai)(gai)革要求明確(que)監(jian)管(guan)(guan)(guan)(guan)責(ze)任(ren)。要落實(shi)放(fang)管(guan)(guan)(guan)(guan)結合(he)、并重要求,按照(zhao)“誰(shui)審(shen)批(pi)(pi)、誰(shui)監(jian)管(guan)(guan)(guan)(guan),誰(shui)主(zhu)管(guan)(guan)(guan)(guan)、誰(shui)監(jian)管(guan)(guan)(guan)(guan)”原(yuan)則(ze),切實(shi)履行(xing)監(jian)管(guan)(guan)(guan)(guan)職責(ze),堅決糾正“以批(pi)(pi)代(dai)管(guan)(guan)(guan)(guan)”、“不批(pi)(pi)不管(guan)(guan)(guan)(guan)”問題(ti),防止出現監(jian)管(guan)(guan)(guan)(guan)真空。直(zhi)接取消審(shen)批(pi)(pi)、審(shen)批(pi)(pi)改(gai)(gai)(gai)為(wei)備(bei)案(an)的(de),由(you)(you)原(yuan)審(shen)批(pi)(pi)部門(men)依法(fa)(fa)承擔監(jian)管(guan)(guan)(guan)(guan)職責(ze)。實(shi)行(xing)告知承諾、優化審(shen)批(pi)(pi)服務的(de),由(you)(you)審(shen)批(pi)(pi)部門(men)負(fu)責(ze)依法(fa)(fa)監(jian)管(guan)(guan)(guan)(guan)持證(zheng)經(jing)營企(qi)業、查處無證(zheng)經(jing)營行(xing)為(wei)。實(shi)行(xing)相對(dui)集中行(xing)政許(xu)可權改(gai)(gai)(gai)革或者綜合(he)行(xing)政執法(fa)(fa)改(gai)(gai)(gai)革的(de)地區,按照(zhao)省(sheng)級人民政府(fu)(fu)制定(ding)的(de)改(gai)(gai)(gai)革方案(an)確(que)定(ding)監(jian)管(guan)(guan)(guan)(guan)職責(ze)、健全審(shen)管(guan)(guan)(guan)(guan)銜接機(ji)制。堅持政府(fu)(fu)主(zhu)導、企(qi)業自治、行(xing)業自律、社會監(jian)督,壓實(shi)企(qi)業主(zhu)體(ti)責(ze)任(ren),支(zhi)持行(xing)業協會提升自律水平,鼓勵新(xin)聞媒體(ti)、從業人員、消費者、中介機(ji)構等發揮監(jian)督作用,健全多元共治、互為(wei)支(zhi)撐的(de)協同監(jian)管(guan)(guan)(guan)(guan)格(ge)局(ju)。(二)根(gen)(gen)據(ju)改(gai)革方(fang)(fang)式健全(quan)監(jian)(jian)(jian)(jian)管(guan)(guan)規則。國(guo)(guo)務院有關部門要(yao)(yao)(yao)根(gen)(gen)據(ju)涉企(qi)經營許可事項的(de)改(gai)革方(fang)(fang)式,分領域制定(ding)全(quan)國(guo)(guo)統(tong)一(yi)、簡明(ming)易行的(de)監(jian)(jian)(jian)(jian)管(guan)(guan)規則,建(jian)立健全(quan)技術、安全(quan)、質量、產品、服務等方(fang)(fang)面的(de)國(guo)(guo)家標準,為(wei)監(jian)(jian)(jian)(jian)管(guan)(guan)提(ti)供(gong)明(ming)確指引。直接取消審(shen)批(pi)(pi)的(de),有關主(zhu)管(guan)(guan)部門要(yao)(yao)(yao)及時(shi)掌握新設(she)企(qi)業情況,納(na)入監(jian)(jian)(jian)(jian)管(guan)(guan)范圍(wei),依(yi)法(fa)實施監(jian)(jian)(jian)(jian)管(guan)(guan)。審(shen)批(pi)(pi)改(gai)為(wei)備(bei)案(an)的(de),要(yao)(yao)(yao)督促有關企(qi)業按規定(ding)履行備(bei)案(an)手續,對(dui)(dui)未按規定(ding)備(bei)案(an)或者(zhe)提(ti)交虛假備(bei)案(an)材料的(de)要(yao)(yao)(yao)依(yi)法(fa)調查(cha)處(chu)理。實行告知承(cheng)諾的(de),要(yao)(yao)(yao)重(zhong)點(dian)對(dui)(dui)企(qi)業履行承(cheng)諾情況進行檢(jian)查(cha),發現(xian)違反承(cheng)諾的(de)要(yao)(yao)(yao)責令限期整(zheng)(zheng)改(gai),逾期不(bu)整(zheng)(zheng)改(gai)或者(zhe)整(zheng)(zheng)改(gai)后仍未履行承(cheng)諾的(de)要(yao)(yao)(yao)依(yi)法(fa)撤銷相關許可,構成違法(fa)的(de)要(yao)(yao)(yao)依(yi)法(fa)予以(yi)處(chu)罰。下放審(shen)批(pi)(pi)權(quan)限的(de),要(yao)(yao)(yao)同步調整(zheng)(zheng)優化監(jian)(jian)(jian)(jian)管(guan)(guan)層級,實現(xian)審(shen)批(pi)(pi)監(jian)(jian)(jian)(jian)管(guan)(guan)權(quan)責統(tong)一(yi)。(三(san))結(jie)合行業(ye)(ye)特(te)點完善(shan)監(jian)管(guan)(guan)(guan)方(fang)法(fa)。對(dui)一般行業(ye)(ye)、領(ling)域,全面推行“雙隨機(ji)、一公(gong)開(kai)”監(jian)管(guan)(guan)(guan),根據(ju)企(qi)(qi)業(ye)(ye)信(xin)(xin)用風(feng)險分類結(jie)果實(shi)施(shi)(shi)差異化(hua)監(jian)管(guan)(guan)(guan)措施(shi)(shi),持續推進常(chang)態化(hua)跨部門聯合抽查。對(dui)直接涉(she)及公(gong)共安(an)全和人(ren)(ren)民群眾(zhong)生命健(jian)康等(deng)特(te)殊(shu)行業(ye)(ye)、重(zhong)點領(ling)域,落實(shi)全覆蓋重(zhong)點監(jian)管(guan)(guan)(guan),強(qiang)(qiang)化(hua)全過(guo)程質量管(guan)(guan)(guan)理,守牢安(an)全底線。要(yao)(yao)充分發揮(hui)信(xin)(xin)用監(jian)管(guan)(guan)(guan)基(ji)礎性作用,建(jian)立(li)企(qi)(qi)業(ye)(ye)信(xin)(xin)用與自(zi)然人(ren)(ren)信(xin)(xin)用掛鉤機(ji)制,依法(fa)依規實(shi)施(shi)(shi)失信(xin)(xin)懲(cheng)戒。要(yao)(yao)建(jian)立(li)健(jian)全嚴(yan)重(zhong)違(wei)法(fa)責任企(qi)(qi)業(ye)(ye)及相關人(ren)(ren)員行業(ye)(ye)禁入(ru)制度,增強(qiang)(qiang)監(jian)管(guan)(guan)(guan)威(wei)懾力(li)。對(dui)新技術、新產業(ye)(ye)、新業(ye)(ye)態、新模式等(deng)實(shi)行包容審慎監(jian)管(guan)(guan)(guan),量身定制監(jian)管(guan)(guan)(guan)模式,對(dui)輕(qing)(qing)微違(wei)法(fa)行為依法(fa)從輕(qing)(qing)、減(jian)輕(qing)(qing)或者(zhe)免(mian)予行政處罰。深(shen)入(ru)推進“互(hu)聯網(wang)(wang)+監(jian)管(guan)(guan)(guan)”,探索智慧監(jian)管(guan)(guan)(guan),加強(qiang)(qiang)監(jian)管(guan)(guan)(guan)數(shu)據(ju)共享,運(yun)用大數(shu)據(ju)、物聯網(wang)(wang)、人(ren)(ren)工智能(neng)等(deng)手段精準(zhun)預(yu)警風(feng)險隱患。五、采(cai)取有力(li)措施(shi)確保(bao)改革落(luo)地見(jian)效(xiao)(一)健全改(gai)革(ge)工(gong)作機制。國務(wu)院推進(jin)(jin)政府職能轉變和“放管(guan)服”改(gai)革(ge)協調(diao)小(xiao)組負(fu)(fu)(fu)責(ze)統籌領導全國“證照分離”改(gai)革(ge)工(gong)作。國務(wu)院辦公(gong)廳、市場監管(guan)總(zong)局、司(si)法部(bu)(bu)牽頭負(fu)(fu)(fu)責(ze)推進(jin)(jin)改(gai)革(ge),做好調(diao)查研(yan)究、政策解讀、協調(diao)指(zhi)導、督促落實、法治(zhi)保障、總(zong)結評(ping)估等工(gong)作。商務(wu)部(bu)(bu)負(fu)(fu)(fu)責(ze)指(zhi)導各(ge)自由(you)貿(mao)易試驗區(qu)做好“證照分離”改(gai)革(ge)與對外開(kai)放政策的銜接。省級人民政府對本地區(qu)改(gai)革(ge)工(gong)作負(fu)(fu)(fu)總(zong)責(ze),要建立(li)健全審改(gai)、市場監管(guan)、司(si)法行政、商務(wu)(自貿(mao)辦)等部(bu)(bu)門牽頭,各(ge)部(bu)(bu)門分工(gong)負(fu)(fu)(fu)責(ze)的工(gong)作機制,強(qiang)化(hua)責(ze)任落實,扎實推進(jin)(jin)改(gai)革(ge)。(二(er))加(jia)強改(gai)革(ge)法(fa)(fa)治保障。要堅(jian)持重大改(gai)革(ge)于法(fa)(fa)有據(ju),依照法(fa)(fa)定(ding)(ding)程序推動改(gai)革(ge)。配(pei)合(he)在(zai)全國范(fan)圍內推行(xing)的(de)改(gai)革(ge)舉(ju)措(cuo),推動修改(gai)法(fa)(fa)律(lv)、行(xing)政法(fa)(fa)規(gui)(gui)有關(guan)(guan)(guan)(guan)規(gui)(gui)定(ding)(ding)。在(zai)自(zi)由(you)貿易試驗區配(pei)合(he)相(xiang)關(guan)(guan)(guan)(guan)改(gai)革(ge)試點舉(ju)措(cuo),根據(ju)全國人(ren)(ren)民(min)(min)代表(biao)大會(hui)常務(wu)委員會(hui)授權決定(ding)(ding)暫(zan)時調(diao)(diao)整(zheng)適(shi)(shi)用《中華人(ren)(ren)民(min)(min)共和國會(hui)計法(fa)(fa)》等7部法(fa)(fa)律(lv)有關(guan)(guan)(guan)(guan)規(gui)(gui)定(ding)(ding),暫(zan)時調(diao)(diao)整(zheng)適(shi)(shi)用《互聯網(wang)(wang)上網(wang)(wang)服務(wu)營業場(chang)所(suo)管(guan)(guan)理條例》等13部行(xing)政法(fa)(fa)規(gui)(gui)有關(guan)(guan)(guan)(guan)規(gui)(gui)定(ding)(ding)(見(jian)附件(jian)3)。國務(wu)院(yuan)有關(guan)(guan)(guan)(guan)部門和地方人(ren)(ren)民(min)(min)政府要根據(ju)法(fa)(fa)律(lv)、行(xing)政法(fa)(fa)規(gui)(gui)的(de)調(diao)(diao)整(zheng)情(qing)況,對(dui)規(gui)(gui)章、規(gui)(gui)范(fan)性文(wen)件(jian)作相(xiang)應調(diao)(diao)整(zheng),建立與(yu)改(gai)革(ge)要求(qiu)相(xiang)適(shi)(shi)應的(de)管(guan)(guan)理制度。2022年底前,國務(wu)院(yuan)有關(guan)(guan)(guan)(guan)部門要組織對(dui)暫(zan)時調(diao)(diao)整(zheng)適(shi)(shi)用法(fa)(fa)律(lv)、行(xing)政法(fa)(fa)規(gui)(gui)有關(guan)(guan)(guan)(guan)規(gui)(gui)定(ding)(ding)情(qing)況開(kai)展(zhan)中期評估。(三)抓好(hao)改(gai)革(ge)(ge)實(shi)施(shi)工(gong)作。國務(wu)(wu)院有關部門(men)要制(zhi)定(ding)實(shi)施(shi)方案(an),對中央層面(mian)設定(ding)的涉(she)企(qi)經營許(xu)可事(shi)項逐項細化(hua)改(gai)革(ge)(ge)舉措,并向社(she)(she)會公(gong)布。各省(sheng)、自(zi)治(zhi)區、直轄市人民政府(fu)要制(zhi)定(ding)本地(di)區改(gai)革(ge)(ge)實(shi)施(shi)方案(an),以省(sheng)為單位編制(zhi)地(di)方層面(mian)設定(ding)的涉(she)企(qi)經營許(xu)可事(shi)項改(gai)革(ge)(ge)清單,并向社(she)(she)會公(gong)布。各地(di)區、各部門(men)要做好(hao)改(gai)革(ge)(ge)政策工(gong)作培(pei)訓和宣傳解(jie)讀,調整優化(hua)業務(wu)(wu)流程,修訂完善工(gong)作規則和服務(wu)(wu)指南,改(gai)造升級信息(xi)系統,確保(bao)改(gai)革(ge)(ge)措施(shi)全(quan)面(mian)落實(shi)、企(qi)業充(chong)分享受改(gai)革(ge)(ge)紅利。本通(tong)知(zhi)實(shi)施中的重(zhong)大問題,省級人民政府、國(guo)務(wu)院有關部門要及時向國(guo)務(wu)院請示報(bao)告。
